1. Site Identification and Publisher

This website, www.theheroprotocol.com (the "Site"), is owned, operated, and published by The Hero Protocol LLC, a limited liability company organized under the laws of the State of Colorado, United States ("Company," "we," "us," or "our").

Inquiries, legal correspondence, and notices may be directed to info@theheroprotocol.com or through the contact form on the Site. Service of legal process must be made on Company’s registered agent in the State of Colorado as listed in the public records of the Colorado Secretary of State.

2. Important Notice Before Use

Read this Notice in full before accessing the Site or purchasing or using any product. By continuing past this point, you agree to be bound by all terms referenced below.

2.1 Adults Only

The Site and all products sold by Company are intended exclusively for adults at least 18 years of age. By accessing the Site or placing an order, you represent and warrant that you are at least 18 years of age, are of sound mind, and have full legal capacity to enter into a binding agreement in your jurisdiction. Company does not knowingly market to, or accept orders from, minors.

2.2 Dietary Supplements; No Disease Claims

Products sold by Company are dietary supplements. They are not drugs, medical devices, or treatments. Statements regarding Company products have not been evaluated by the United States Food and Drug Administration. Company products are not intended to diagnose, treat, cure, mitigate, or prevent any disease, and no statement from Company, the Site, packaging, labels, customer service, third parties, testimonials, reviews, social media, affiliates, influencers, or any other source shall be construed as a disease claim.

You shall consult a licensed healthcare professional before using any dietary supplement, particularly if you are pregnant, nursing, planning to become pregnant, under 18, have a known medical condition, are scheduled for surgery, or are taking prescription or over-the-counter medications. You shall not disregard, avoid, or delay obtaining professional medical advice because of any information you have received from Company or any source connected to Company.

2.3 Independent Research and Publications

Company personnel and affiliated parties may publish, contribute to, or be cited in independent academic, clinical, or scholarly works that reference Company products or their ingredients. Any such publication reflects the views of its authors, is subject to the editorial standards of the publishing venue, and is not a representation by Company regarding the efficacy of any product. The existence of such publications does not constitute a disease claim or a guarantee of any specific outcome.

2.4 Individual Results

Testimonials, reviews, and case examples reflect the experiences of specific individuals and are not a guarantee, warranty, or prediction that you will experience the same or similar results. Individual responses to dietary supplements vary.

3. Intellectual Property

All content on the Site, including text, graphics, logos, product names, product imagery, packaging, labels, inserts, protocols, marketing copy, and the overall design and arrangement of the Site, is owned by Company or its licensors and is protected by United States and international copyright, trademark, trade dress, patent, and trade secret laws.

"The Hero Protocol," the Hero Protocol logo, and any associated marks are trademarks of Company. Use of any Company mark or content without prior written authorization is prohibited. Reverse engineering, replication, benchmarking for competitive purposes, and other restricted uses are governed by Section 2 of the Terms of Sale, Website Use, and Limited License.

4. Jurisdiction and Restricted Sales

Company sells and ships products only within the fifty (50) United States, subject to the limitations stated in the Shipping Policy. Company does not ship to U.S. Territories or internationally. APO and AE addresses are evaluated case by case.

Certain products may be subject to state, local, or municipal restrictions. You are solely responsible for verifying that any product you order may lawfully be purchased, possessed, and used at your location. Placing an order from a jurisdiction where the order is unlawful is a breach of these Terms, and you assume all resulting liability.

The Site is operated from the United States. Company makes no representation that the Site or any product is appropriate or available for use in any other location. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with all applicable local laws.

5. Limitation of Liability and Assumption of Risk

To the maximum extent permitted by applicable law, Company, its officers, members, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of the Site or any product, even if Company has been advised of the possibility of such damages. Company’s aggregate liability arising out of or relating to these Terms or any product shall not exceed the greater of the amount you paid Company for the product giving rise to the claim in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100).

You acknowledge that dietary supplements may produce different effects in different individuals, and you assume all risks associated with your decision to use any Company product.

6. Governing Law, Venue, and Class Action Waiver

These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to the Site, any product, or any policy referenced in this Notice shall be resolved exclusively in the state or federal courts located in El Paso County, Colorado, and the parties consent to the personal jurisdiction of those courts. You waive any right to participate in any class, collective, or representative action against Company. All disputes shall be resolved on an individual basis.

7. Governing Documents and Order of Precedence

Your use of the Site and any product is governed by the following documents, each of which is incorporated into this Notice by reference and is available on the Site:

•         Terms of Sale, Website Use, and Limited License

•         Shipping Policy

•         Privacy Policy

•         Any product-specific terms or addenda posted on the Site

In the event of a conflict between this Notice and any of the foregoing documents, the document specifically governing the subject matter at issue shall control. Company reserves the right to update any of the foregoing documents at any time, with changes effective upon posting to the Site.

8. Severability

If any provision of this Notice or any document referenced in it is held invalid or unenforceable, that provision shall be modified to the minimum extent necessary to be enforceable, and the remaining provisions shall remain in full force and effect.
